Arcata, Calif. & Cambridge, England? Carlson and Neul today announced the launch of RuralConnect, the first commercially available radio networking system to deliver the full promise of TV white space broadband to WISPs (Wireless Internet Service Providers). RuralConnect, the first product in a line co-created by the two leaders in white space technologies, follows the announcement of a global partnership in October 2011, and is aimed at bringing affordable broadband to millions around the world.

The Neul and Carlson system will give users up to 16 Mbps of bandwidth for each available vacant TV channel and unmatched ability to make long range, non-line-of-sight links. Designed specifically for the needs of wireless Internet service providers (WISPs), RuralConnect has been priced to make it immediately commercially viable. Samples and development kits are available now, with volume shipments of the new system to start as soon as Q2, 2012.

Thanks to the extension of the Payroll Tax Bill, passed in February 2012, white space radio is now fully available in the US, opening up a host of opportunities and new markets that are currently difficult to serve without expensive licensed spectrum or extensive infrastructure. This has piqued the interest of many investors and venture capitalists looking to tap in to the unlimited possibilities of this emerging technology.

RuralConnect technology, jointly developed by Neul and Carlson, uses ?white spaces,? (or unused portions of UHF spectrum), for digital communication. Due to its outstanding propagation characteristics, UHF signals can travel through walls and other obstacles: Line of sight is not needed to the subscriber?s home.

However, It is not enough just to be able to send a signal a long way. On long-range links reflections from buildings and terrain cause signals to travel via many different routes from the transmitter to the receiver. These multipath signals interfere can with each other, potential causing unreliable, slow connections. RuralConnect uses state of the art SCFDE technology to cancel the effect of multipath allowing reliable long range connections, whatever the terrain.

As a result WISPs using the new system can offer superior coverage over wide areas with limited base-station sites. It also enables the transfer of more data at higher data rates, driving additional revenue with minimal additional investment. Depending on the area, up to 20 channels are available, increasing the amount of non-line-of-sight capable spectrum available by a factor of 10.

Concurrently, Carlson is launching a line of omnidirectional and sectoral, high-gain, base-station antennas designed specifically for TV white-space broadband. The first of their kind, these antennas are powerful, affordable, and energy efficient.

Technology Properties Limited Files New 337 Complaint Regarding ...

On March 26, 2012, Technology Properties Limited LLC (?TPL?) filed a complaint requesting that the ITC commence an investigation pursuant to Section 337.

The complaint alleges that the following entities (collectively, the ?Proposed Respondents?) unlawfully import into the U.S., sell for importation, and/or sell within the U.S. after importation certain computers and computer peripheral devices, components thereof, and products containing the same that infringe one or more claims of U.S. Patent Nos. 6,976,623 (the ?623 patent), 7,162,549 (the ?549 patent), 7,295,443 (the ?443 patent), 7,522,424 (the ?424 patent), 6,438,638 (the ?638 patent), and 7,719,847 (the ?847 patent):

According to the complaint, TPL is the exclusive licensee of the asserted patents, all of which are?generally directed to flash memory readers.? The ?623 patent discloses a memory card apparatus having more than one interface to read at least two different types of memory cards, allowing faster data transfer between flash cards.? The ?549 patent is directed to a system with a controller chip that interfaces with a flash memory card and can conduct bad block mapping to reduce errors.? The ?443 patent discloses a multi-media memory adapter capable of receiving multiple types of flash memory cards.? The ?638 patent is directed to a multi-flash card reader that uses a converter chip to read data from different kinds of flash cards.? The ?424 patent and the ?847 patent are both directed to an apparatus with a port having multiple sets of contact pins adapted to interface with different types of flash memory cards.

The complaint describes the infringing activities of each of the Proposed Respondents separately and specifically identifies a number of allegedly infringing products associated with each of the various Proposed Respondents, including, among other items, lap tops, card readers, and printers.

With regard to related litigation, the complaint states that TPL is concurrently filing civil actions in the U.S. District Court for the Eastern District of Texas accusing the same parties of infringing the asserted patents.? ASUSTek Computer Inc. filed a declaratory judgment of noninfringement against TPL and other parties in February, 2008 based on the ?623 patent and the ?638 patent, among other patents.? Soon after, TPL filed two suits against ASUSTek Computer Inc. in the U.S. District Court for the Eastern District of Texas, one alleging infringement of the ?443 and ?549 patents, and one alleging infringement of the ?623 patent, among others.? These cases have all been dismissed based on settlement.? TPL filed a complaint for violation of Section 337 against 18 respondents in relation to the ?623, ?443, ?549, and ?424 patents (Investigation No. 337-TA-807, see our August 26, 2011 post for more details).? This case is still pending at the ITC with 5 respondents remaining.? TPL also filed a complaint against the same 18 defendants in the U.S. District Court for the Eastern District of Texas for infringement of the? ?623, ?443, ?549, and ?424 patents, and this case has been stayed pending resolution of the 337-TA-807 investigation.

TPL asserts that it meets both the economic and technical prongs of the domestic industry requirement, arguing primarily that it has ?made substantial investments in the exploitation of the Asserted Patents through its significant licensing activities, which have resulted in numerous licensees whose products practice the inventions claimed in the ?424, ?443, ?549, ?623, ?638, and ?847 Patents.?? TPL bases this argument on the fact that that its predecessor in interest developed the products and technology that form the ?CORE Flash Patent Portfolio,? and made significant investments in plants, equipment, labor, and capital, resulting in extensive use of the inventions claimed in the asserted patents.? TPL argues that it meets the domestic industry requirement by continuing to make substantial investments in licensing this portfolio, including employing a ?team of IP legal and Research and Development employees who have worked to analyze and license the CORE Flash Portfolio.?

With respect to potential remedy, the complaint requests the Commission to issue permanent limited exclusion and cease and desist orders directed at the Proposed Respondents and their allegedly infringing devices.

Will Dodgers chase Hamels?

FORT MYERS, Fla. ? Wednesday?s news that the Los Angeles Dodgers had been sold for a whopping $2 billion to a group that includes former NBA great Magic Johnson and well-known baseball executive Stan Kasten was certainly noticed in the Phillies? front office.

The Dodgers are one of baseball?s premier franchises and you can bet that Johnson, Kasten and their deep-pocketed partners will be looking to bring the club to the top of the National League in a hurry.

You can also bet they will look to make a splashy talent acquisition to lead that rise, possibly a pitcher with Southern California roots, a great changeup and a World Series MVP trophy.

Of course, we?re talking about Cole Hamels, the Phillies? lefthander who could become a free agent after this season.

It is not difficult to envision Hamels pitching in Chavez Ravine wearing one of those brilliant white Dodgers? uniforms.

Not difficult at all.

But, still, I don?t see it happening.

The Phillies have been trying to negotiate a contract extension with Hamels for months, and with opening day just eight days away you could say the negotiations have reached a critical stage. Though Hamels? side has not set any deadlines, Opening Day has to be considered a pivotal date for both sides because once the season starts Hamels? price tag can go up with a strong performance or down with a poor performance. There is also the risk of injury, a reality that came to the fore with the recent news that Hamels? former Phillies teammate, Ryan Madson, himself a potential free agent this winter, will need season-ending elbow surgery.

For months, the belief here has been that the Phillies will sign Hamels. He?s young (28), talented, home-grown and involved in the community ? all characteristics that the franchise and chief decision-maker David Montgomery value greatly. He helped the club win a World Series. At a time when this club?s position-player nucleus ? the hitters ? is getting old, it is important that the Phillies remain strong in the pitching department. Roy Halladay will be 35 this season. Cliff Lee will be 34. The Phils need Hamels to take the pitching staff into the future ? and they know that.

Both sides have been extremely tight-lipped about the negotiations, but throughout spring training there has been a feeling of general optimism around the Phillies that something will get done, maybe not by Opening Day, but not too far off into the season. One person with knowledge of the situation says the Phils know how much Hamels will cost ? $20 million or more per season ? and are set to pay it. The person said the length of the deal is an issue, that the Phillies would like to do a four-year deal and Hamels wants more. No surprise there as he would certainly get more years than that on the open market.

Another person with knowledge of the situation says the two sides have made good progress in negotiations and the person predicts a signing in the not-too-distant future.

Phillies fans aren?t the only ones curious to see how this drama plays out.

As historic arguments unfold this week before the U.S. Supreme Court on the constitutionality of the Patient Protection and Affordable Care Act (PPACA), it?s not unreasonable that our state?s citizens should want to know what is being argued on their behalf.? After all, their attorney general, Rob McKenna, has joined litigation seeking to overturn, in their name, health care reform.

The second comment to Rule 3.1 of the Rules of Professional Conduct makes it clear attorneys must ?inform themselves about the facts of their clients? cases and the applicable law and determine that they can make good faith arguments in support of their clients? positions.?

Yet statements from Attorney General McKenna suggest, to put it most generously, considerable confusion as to what exactly he?s arguing on behalf of his client: Washington taxpayers.

In a July 6, 2010, press release, McKenna asserted,

Despite what many have reported, this suit will not overturn or repeal the new health care reform legislation. In fact, this lawsuit will not affect most provisions in the 2,400-page bill, including several scheduled to take effect this year. He wrote, ?I must conclude that the individual mandate and the remaining provisions are all inextricably bound together in purpose and must stand or fall as a single unit.? The individual mandate cannot be severed.?

Having never asked Judge Vinson, as he had suggested publicly and in his press release, to do anything other than strike down the entire Act, McKenna proceded to celebrate a decision that had, in fact, struck down provisions ?allowing children access to health insurance regardless of pre-existing conditions and prohibiting insurance companies from denying coverage to existing policy-holders when they fall ill.?

Yet, once again, in a Jan. 6, 2012, filing with the Court on the question of whether any of the PPACA can be saved, McKenna joined other states in arguing, ?The Court should hold the ACA invalid in its entirety? so as to ?honor Congress? evident intent that the ACA stand or fall with the individual mandate.?? Did he argue that with his fingers crossed?

That begs another question: Under Rule 11 of the Federal Rules of Civil Procedure (CR), an attorney?s submission to the U.S. Supreme Court is a representation by that attorney that ?the claims, defenses, and other legal contentions are warranted by existing law or by a nonfrivolous argument for extending, modifying, or reversing existing law or for establishing new law[.]?

ICEX 2012 - Malta & Sicily: A History of Post-Secondary Maltese ...

Last week, the ICEX faculty had the opportunity to meet Professor Carmel Pul?, faculty in the Department of Electronics Systems Engineering at the University of Malta. Dr. Pul? has played an influential role in the development of engineering education in Malta during the last 45 years. He graciously shared his contact information with the faculty, and I contacted him by email earlier this week to ask him about the similarities and differences of the engineering educations provided by MCAST and University of Malta.

His response was fiery and passionate, but well informed and based on an experience with the Maltese education system that few others have had. I?m lucky to be able to hear his story, and am excited to share it. The following is a summary of his account of the history of the Maltese engineering education. It largely focuses on the history of the development of the different engineering degrees offered today by the University of Malta and the Malta College of Arts, Science, and Technology (MCAST). In my next and final blog post, I will discuss some of the statistics concerning the two post-secondary schools and elaborate on the ways in which this history has affected each institution.

Malta lived under British rule for around 150 years (up until 1964), so most of the economy was devoted to establishing and maintaining a skilled workforce for military needs. The British established their own schools in Malta that trained Maltese students in naval studies, military technique, and other similar forms of education. Of these schools, the Dockyard Naval School at Senglea was the best, manned by extremely qualified British teachers. Most students graduating from this school followed a six-year trade apprenticeship and the best students were given an opportunity to go to Britain and proceed to work at Chatham, Devonport, and Portsmouth. Some of these highly skilled Maltese would then return to Malta. (Note: The important role of the Dockyard Naval School as a site of technical education had previously been highlighted for us by Timmy Gambin during our tour of the Maritime Museum the first week.)

In addition to the post-secondary educational opportunities provided by the British military, in the time period prior to independence in 1964, there was the old University of Malta, which had been established by the Knights of Saint John 400 years earlier. At the time, the university focused on arts, culture, and education in the traditional professions of law, medicine, and religion. It offered no Engineering courses. (Research prior to our trip indicates that the size of the student population at the University in the 1950s was approximately 200 students per year.) This lack of attention to technical education was mirrored in Maltese teacher training colleges and at the Lyceum ? the ?junior college? that students attended in between secondary education and enrollment at the University of Malta.

Since the University of Malta did not provide any engineering degrees, pathways to technical education that were not provided by the British military were largely apprenticeship-based. A number of vocational schools were established beginning in 1945. However, these trade schools were not primarily focused on producing academically trained engineers. (An exception to the lower-level vocational-only focus was the Technical College at Paula, which offered Ordinary and Higher National Certificates and Journey Men Certificates and produced students who were able to compete successfully against other students in the British Commonwealth and whose degrees were recognized abroad.)

Up until 1960 (aside from the years of World War II), life in Malta was tranquil. The country had gotten used to its tie to Britain, and had sufficient economic influx to maintain its peaceful lifestyle. However, circa 1960 it became clear that Britain would not be able to continue financial support for its ?oversea empire?, including Malta. Maltese politicians and educators became aware of this, and realized that secondary and post-secondary education should be shifted in such a way that the product of the University of Malta would be a labor force for a self-supporting nation. This labor force would be, by necessity, largely composed of engineers. The University of Malta did not agree with this outlook, and continued to offer its traditional degrees while rejecting the development of courses in engineering.

Meanwhile, Britain (in conjunction with UNESCO) decided to finance a new technical institution in Malta called the Malta College of Arts, Science, and Technology (MCAST). The goal of this new college was the same as the goal of the aforementioned Maltese politicians: to produce workers whose skills would be useful to a competitive independent economy post-independence. The subjects included were mechanical engineering, electrical engineering, tourism, finances, accounting, and economics.

After independence in 1964, the Maltese government did force the University of Malta to offer degrees in engineering. Students who could meet the admittance qualifications at the University of Malta ? which involved Religious and Maltese Language qualifications ? were able to earn B.Sc degrees in engineering at the University. Students who did not meet the Religious and Maltese Language qualifications were able to earn a Diploma in Engineering at

MCAST instead by taking the same coursework. The New University had roughly ten times as many students as the Old University (a total of 10,000 students), and initially focused only on offering degrees with direct economic benefit (such as engineering and tourism). As Professor Pul? put it, ?the modern professors [had] stepped in to University surroundings.? Many faculty members from the Old University left Malta and took positions in England and Saudi Arabia.

Beginning in the 1980s, the (New) University of Malta began to expand its focus to teach all the old subjects plus the new subjects of Engineering, Science, Mathematics and Computer Science. Today, the University has many associated subject institutes focused on topics such as sustainable energy. However, in Professor Pul??s opinion, even the technical courses in today?s University of Malta have become too soft and theoretical, with not enough emphasis on hands-on work and hardware. Its engineering degrees have less lab-based courses than most other universities, and the work with computers largely focuses on accounting, economics, banking, video games, and personal media communication rather than embedded systems, image processing, and robotics. According to Professor Pul?, this means that Malta has recently lost out on investing and manufacturing opportunities with international companies such as Lufthansa.

Thus, Professor Pul? began to work in the 1990s for the opening of a new MCAST that would provide more hands-on education. The goal of this process was to produce high-caliber engineers who have a firm technical and hands-on background. His desire came true, and the ?New MCAST? opened in 2000.

However, Professor Pul? is not entirely satisfied with the new MCAST. According to him, the new MCAST had a slow start due to the fact that it was under staffed and poorly funded. Initially, instructors from the old trade schools were hired, many of whom did not have proper university qualifications. Additionally, Professor Pul? believes that the examination standards of MCAST are not sufficient. While MCAST offers ample hands-on training, Professor Pul? has found the opposite problem from the new University of Malta: the coursework of MCAST is not theoretical in the least. For example, MCAST?s course in Plant Maintenance does not include thermodynamics ? a topic necessary to the class. While Professor Pul? was excited that Professor Maurice Grech was brought in to take over MCAST approximately five years ago, he is concerned that the degrees awarded by MCAST are not equivalent to engineering degrees at other universities. More broadly, Professor Pul? is concerned that the standards of admission to both MCAST and the University of Malta, and examination while at university, are too low.

Today Professor Pul? remains hopeful about the development of his vision of high quality engineering education in Malta. He continues to believe that Malta must produce high-caliber, technically focused, creative engineers, educated via a combination of theoretical and hands-on training in order to create a truly independent and successful Malta. At the same time, Professor Pul? sees a continued role for vocational training. Above all, Professor Pul? wants Malta, its government and its citizens, to commit to the hard work of the development of a practical workforce and to maintaining high standards in its educational system.
